Dworkin respondeu afirmativamente à pergunta título do seu texto “Não existe mesmo nenhuma resposta certa em casos controversos?”. Posner criticou Dworkin e respondeu a mesma pergunta negativamente. Discute-se neste artigo as diferentes maneiras como cada filósofo entendeu a pergunta que acarreta diferentes respostas a ela, isto é, de que modo diferenças na concepção do que é o Direito acarretam diferenças a respeito da existência de respostas certas para questões jurídicas.

We formulate Suppes predicates for various kinds of space-time: classical Euclidean, Minkowski's, and that of General Relativity. Starting with topological properties, these continua are mathematically constructed with the help of a basic algebra of events; this algebra constitutes a kind of mereology, in the sense of Lesniewski. There are several alternative, possible constructions, depending, for instance, on the use of the common field of reals or of a non-Archimedian field (with infinitesimals). Our approach was inspired by the work of Whitehead (...) (1919), though our philosophical stance is completely different from his. In this paper, we provide a new formulation of a coherence theory of truth using the resources of the partial structures approach − in particular the notions of partial structure and quasi-truth. After developing this new formulation, we apply the resulting theory to the philosophy of mathematics, and argue that it can be used to develop a new account of nominalism in mathematics. This application illustrates the strength and usefulness of the proposed formulation of a coherence theory of truth.

This paper is a historical companion to a previous one, in which it was studied the so-called abstract Galois theory as formulated by the Portuguese mathematician José Sebastião e Silva ). Our purpose is to present some applications of abstract Galois theory to higher-order model theory, to discuss Silva's notion of expressibility and to outline a classical Galois theory that can be obtained inside the two versions of the abstract theory, those of Mark Krasner and of Silva. Our purpose in this paper is to delineate an ontology for quantum mechanics that results adequate to the formalism of the theory. We will restrict our aim to the search of an ontology that expresses the conceptual content of the recently proposed modal-Hamiltonian interpretation, according to which the domain referred to by non-relativistic quantum mechanics is an ontology of properties. The usual strategy in the literature has been to focus on only one of the interpretive problems of the theory and (...) to design an interpretation to solve it, leaving aside the remaining difficulties. On the contrary, our aim in the present work is to formulate a “global” solution, according to which different problems can be adequately tackled in terms of a single ontology populated of properties, in which systems are bundles of properties. In particular, we will conceive indistinguishability between bundles as a relation derived from indistinguishability between properties, and we will show that states, when operating on combinations of indistinguishable bundles, act as if they were symmetric with no need of a symmetrization postulate. In this article I aim to clarify the role of science and technology in Weil's account of the formation and maintenance of the bureaucratic state as a totalitarian form of State, which allows to identify the similarities between capitalist, fascist and communist regimes. In the first section I characterize Weil's conception of modernity. Having The Need for Roots as my main reference, first, I reconstruct Weil's conceptualization of human nature, after I explore the meanings and signs of uprootedness and Weil's (...) critique of Marxism. In the second section, I analyze the relationship between Revolution, Totalitarianism and the invention of the bureaucratic State. I retake Weil's critique of Marx and the Marxists arguing that science and technology must be subjected to a new criticism today, for they have been reduced to mere means of a totalitarian logic, which ultimately reinforces social oppression. I conclude by rescuing Weil's defense of the fundamental value of individual freedom and of thought, for our humanity lies in it. (shrink)

This paper seeks to provide an approach for achieving a more socially and environmentally sustainable life by reframing the rules of engagement with the planet and with each other by setting minimum standards on essential criteria i.e., by defining “off-limits”zones for corporate action. For a more humanistic and socially just way of living life that would sustain the planet, a set of moral boundaries that cannot be breached are conceived. We offer a set of possible normative leverage points that must (...) not be violated by business in the long-term. Our paper takes a forward-looking view beyond the current generational targets for sustainability. We operate on the premise that sustainability involves preserving the future generations of the planet in both an environmental and human sense. The Moral Boundaries for Business framework embraces the Seventh Generation Principle. The moral boundaries we offer in this paper, if followed, are meant to have positive implications for humanity and the planet in the next seven generations. (shrink)

ISBN: 0 88344 723 1. pp. 301. Griffiths presents a rigorous argument for the possibility of con· (...) tradictory claims between different religious communities. His inspira· tion, as he acknowledges, is William Christian Snr. His basic argu· ment is: " If representative intellectuals belonging to some specific religious community come to judge at a particular time that some or all of their own doctrine-expressing sentences are incompatible with some alien religious claim(s), then they should feel obliged to engage in both positive and negative apologetics vis-a-vis these alien religious claim(s) and their promulgators" (3). He takes negative apologetics to be a critique of arguments made against one's own religious claims, showing that such arguments fail or are inconsistent or incoherent. Positive apologetics shows how a particular religious community's doctrines are cognitively superior, in some respect(s), to another religious community 's doctrines. It is essential for this enterprise that only methods of argumentation and criteria of knowledge acceptable to the adversary are employed. This requires the acceptance of natural theology. Griffiths is well aware of the lion's den he is entering, as his proposals run counter to much scholarship in the area of interreligious dialogue, so he spends three chapters apologetically tackling the lions. The objectors (who mainly remain in notes) include Derrida, Barthes, Winch, Lindbeck, Hick, Huxley, Nasr, Plantinga and others, although Mac· Intyre is curiously missing. This technique has the advantage of isolating and presenting arguments, without falling into problems of cor· rect exegesis of opponents. And this is also its weakness, as objectors will sometimes feel caricatured or misunderstood-as is surely the case with Plantinga and in one instance, Hick. First, he tackles objections that sentences from one tradition are either incomprehensible or incommensurable with those of another, convincingly showing that the strong versions of both claims are self· defeating and unsustainable. Weaker versions still allow for his proj· ect-or so he thinks. This is where Maclntyre's work should have been considered. Then he tackles various theories of religious language (following Lindbeck's typology). He argues against non-cognitive accounts that reduce beliefs to the credibility of causes for holding beliefs, a position incapable of asserting its truth over other views because of its 720 BOOK REVIEWS own presuppositions. He follows Lindbeck in criticizing experiental expressivism, and then turns upon Lindbeck's own form of rule theory (which is ambivalent regarding cognitive claims), arguing convincingly that to suggest that only sentences uttered confessionally and with performative function can possess ontological truth is confused (42). In a brief review it is not possible to rehearse Griffiths's careful argumentation. Griffiths then sets about tackling two types of universalists: Hick and Huxley. Of Hick, he argues that some criteria are required to discern true from false religions (e.g. Jim Jones) and in so doing such a position needs to support and develop such criteria, thereby effectively introducing apologetics. He neglects to deal with Hick's pragmatic criteria of beneficial ' fruits ' evident in adherents, but the logic of his argument can be applied to Hick's proposals. Using Katz and Zaehner, he argues against the esoteric universalism of the philosophia perennis. (The arguments of Robert Forman's recent book, The Problems of Pure Consciousness, are strangely neglected, despite Griffiths's being a contributor to that collection.) Finally, he tackles objections against positive apologetics-first, on the grounds that it has a negative effect on interreligious relations. Logically, this need not be the case, although Griffiths is well aware that the political context of apologetics can obscure its proper goal: deeper critical understanding, learning and problem solving. Then, in sustained dialogue with Plantinga, he argues against the objection that success is impossible. It is impossible only if " knockdown drag-out" (64) argumentative victory is expected. Tocqueville e John Stuart Mill são dois dos grandes mestres de ciência política e filosofia política. Com efeito, poderíamos dizer que somos todos discípulos destes autores. Por um lado, porque Tocqueville foi o primeiro autor a refletir sobre o paradigma democrático, entendido como constelação política especificamente moderna. Por outro lado, o conceito ou ideal de liberdade desempenha um papel central nos dois autores. Liberdade é um dos pilares fundadores de qualquer projeto democrático e apesar do reconhecimento da importância igualmente vital (...) do conceito de igualdade, que se vem afirmando como condição necessária para o desenvolvimento politico na era de Tocqueville e de Mill, a liberdade permanece central nas suas preocupações. Neste artigo irei revisitar os argumentos avançados pelos autores, argumentos estes que nos alertam para os perigos da democracia, e mais precisamente, a tirania da maioria. Começarei por retratar o contexto das obras de Democracia na América de Tocqueville e Sobre a Liberdade de Mill. De seguida, ofereço uma reflexão sobre as implicações da tirania da maioria hoje. Por fim, proponho um conjunto de medidas que nos poderão ajudar a contrabalançar as tendências antidemocráticas das democracias contemporâneas. (shrink)

Com os conceitos de vida como “organismo em interação com o meio”, de John Dewey, e de vida, como “vontade de potência”, de Friedrich Nietzsche, elaborados em resposta à problemática envolvendo questões de experiência estética, buscamos, no presente artigo, analisar possíveis similaridades entre eles e, assim, destacar a relevância atual dessas abordagens para se pensar uma estética menos canônica, mais atenta aos afetos e, portanto, mais próxima da vida.

We first show that a theorem by Cartan that generalizes the Frobenius integrability theorem allows us (given certain conditions) to obtain noncurvature solutions for the differential Bianchi conditions and for higher-degree similar relations. We then prove that there is no algorithmic procedure to determine, for a reasonable restricted algebra of functions on spacetime, whether a given connection form satisfies the preceding conditions. A parallel result gives a version of Gödel's first incompleteness theorem within an (axiomatized) theory of gauge fields.

We expose the main ideas, concepts and results about Jaśkowski's discussive logic, and apply that logic to the concept of pragmatic truth and to the Dalla Chiara-di Francia view of the foundations of physics.

Body awareness refers to the individual ability to process signals originating from within the body, which provide a mapping of the body’s internal landscape and its relation with space and movement. The present study aims to evaluate psychometric properties and validate in French two self-report measures of body awareness: the Postural Awareness Scale, and the last version of the Multidimensional Assessment of Interoceptive Awareness questionnaire. We collected data in a non-clinical, adult sample using online survey, and a subset of the (...) original sample also completed the retest control. Factor analyses and reliability analyses were conducted. Construct validity of the PAS and the MAIA-2 were examined by testing their association with each other, and with self-report measures of personality, alexithymia and dispositional trait mindfulness. Factor analyses of the PAS supported the same two-factor structure as previously published versions. For the MAIA-2, factor analyses suggested that a six-factor structure, excluding Not-Worrying and Not-Distracting factors, could successfully account for a common general factor of self-reported interoception. We found satisfactory internal consistency, construct validity, and reliability over time for both the PAS and the MAIA-2. Altogether, our findings suggest that the French version of the PAS and the MAIA-2 are reliable self-report tools to assess both components of body awareness. (shrink)

We apply the recently elaborated notions of 'pragmatic truth' and 'pragmatic probability' to the problem of the construction of a logic of inductive inference. It is argued that the system outlined here is able to overcome many of the objections usually levelled against such attempts. We claim, furthermore, that our view captures the essentially cumulative nature of science and allows us to explain why it is indeed reasonable to accept and believe in the conclusions reached by inductive inference.

The article explores the rich and varied experiences of a collective writing project, unfolding through an anecdote involving Charlie, a young boy who creatively disrupted conventional photography methods. This incident, during an evening promenade by the sea in Ericeira (Portugal), epitomizes the project's embrace of playfulness and exploration of diverse perspectives–materialized through Charlie's playful insistence on experimenting with different angles. The event embodied the group’s approach to writing, leading to a collective inquiry into the interplay of ages, angles, and other (...) themes like waves, threads, shadows, and liminal spaces. The project, driven by the Between Ages Collective, began with informal gatherings in Plymouth, UK, and expanded into a year-long online reading group. Participants, spanning different generations and academic stages, shared various materials, including films, picture books, and scholarly texts, which inspired individual contributions. Influenced by the Collective's collaborative spirit, these contributions explore the concept of 'between ages' – a metaphorical and literal space of transition and fluidity. Contributors were invited to craft pieces that delve into the 'between ages' theme, often exploring serendipitous moments that transform interactions and experiences. The writing tries to capture a sense of openness and curiosity, embracing the uncertainties and ambiguities inherent in the process. The works do not strictly adhere to conventional academic or narrative forms but rather emerge from the collective's shared experiences, including cooking, eating, swimming and walking together. The article suggests that these writings are not meant to be definitive or conclusive but are explorations that invite readers to engage with the mundane and profound textures of everyday life. The stories and themes explored are marked by their diversity in style, rhythm, and imagery, ranging from reflections on the philosophy of shadows to the profound implications of intergenerational and interspecies relationships. The Collective’s work is presented as an ongoing experiment in thinking and writing together, with each piece offering unique insights into the fluid and often blurred boundaries between different states of being. This openness to the in-between spaces brings into question the notion of fixed identities and experiences, inviting a more nuanced understanding of the relational dynamics that shape existence. The article allows the readers to delve into these narratives and engage with the myriad ways they resonate with broader themes of being, storying, and connecting. (shrink)

David hume is sometimes viewed as a skeptic who argues that none of our beliefs about the world are justified. this paper challenges that view by developing and explicating an account of justified belief that is compatible with hume's theories about belief formation, inference, and principles governing the association of ideas. it is noted that the resultant account bears some resemblance to contemporary causal/reliability views of justification.

We use Padoa's principle of independence of primitive symbols in axiomatic systems in order to show that time is dispensable in continuum thermodynamics, according to the axiomatic formulation of Gurtin and Williams. We also show how to define time by means of the remaining primitive concepts of Gurtin and Williams system. Finally, we introduce thermodynamics without time as a primitive concept.

O tema é discricionariedade nas teorias do positivismo antes e depois de Dworkin desde a crítica hermenêutica do direito e sua teoria da decisão. O problema é: há a possibilidade de uma teoria da decisão no positivismo, seja ele qual for, mantendo-se intactos os seus princípios metodológicos da descrição e da separação entre direito e moral? O objetivo é apresentar a crítica hermenêutica do direito e sua oposição à discricionariedade dos positivismos. A conclusão é a de que a crítica hermenêutica (...) não é apenas negativa com relação aos positivismos, ela é também positiva e construtiva de uma teoria da decisão. (shrink)

This chapter examines the normative question of whether the cultivation of patriotic and nationalist ideals and attachments should have a central place in programs of civic education. It argues that the most useful way to draw the distinction between patriotism and nationalism focuses on their respective objects of loyalty; patriotism is loyalty to a country while nationalism is loyalty to a people. This way of distinguishing between patriotism and nationalism forms the background for the discussion of a variety of instrumental (...) and non-instrumental arguments for cultivating patriotic and nationalist political attachments in schools. It also examines an assumption common to these programs of civic education: that a shared identity is crucial for citizens to have a sense of belonging that supports social stability and desirable forms of political change. The final part of the chapter introduces a number of alternative educational proposals that aim to avoid some of the difficulties faced by patriotic and nationalist strategies. These alternative proposals aim to encourage good citizenship while taking into account new challenges generated by the political, social, and economic conditions of an increasingly globalized world. Realist interpretations of quantum mechanics presuppose the existence of elements of reality that are independent of the actions used to reveal them. Such a view is challenged by several no-go theorems that show quantum correlations cannot be explained by non-contextual ontological models, where physical properties are assumed to exist prior to and independently of the act of measurement. However, all such contextuality proofs assume a traditional notion of causal structure, where causal influence flows from past to future according to ordinary (...) dynamical laws. This leaves open the question of whether the apparent contextuality of quantum mechanics is simply the signature of some exotic causal structure, where the future might affect the past or distant systems might get correlated due to non-local constraints. Here we show that quantum predictions require a deeper form of contextuality: even allowing for arbitrary causal structure, no model can explain quantum correlations from non-contextual ontological properties of the world, be they initial states, dynamical laws, or global constraints. Despite the tremendous empirical success of quantum theory there is still widespread disagreement about what it can tell us about the nature of the world. A central question is whether the theory is about our knowledge of reality, or a direct statement about reality itself. Current interpretations of quantum theory, regardless of their stance on this question, regard the Born rule as fundamental and add an independent state update (or ‘collapse’) rule to describe how quantum states change upon measurement. In (...) this paper we present an alternative perspective and derive a unified probability rule that subsumes both the Born rule and the collapse rule. We show that this more fundamental probability rule can provide a rigorous foundation for informational, or ‘knowledge-based’, interpretations of quantum theory. Our result requires an assumption of instrument non- contextuality, a key notion that generalises previous approaches to non-contextuality. Therefore, the framework also permits one to consider non-contextuality in scenarios with arbitrary causal structure. (shrink)

After mentioning the cogent connection between pure semantics and the particular set theoretical framework in which it is formulated, some issues regarding the conceptual status of semantics itself, as well as its relationship to logic, are concisely raised.

This paper combines a non-contingency logic with an epistemic logic by means of fusions and products of modal systems. Some consequences of these interplays are pointed out.
